1. Agreement to terms

These Terms of Use (“Terms”) govern access to and use of the websites, applications, APIs, documentation, and related services offered by Feedico (“Feedico”, “we”, “us”) at feedico.io and associated domains (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

If you do not agree, do not use the Services. We may refuse service or close accounts that violate these Terms.

2. Eligibility and accounts

The Services are intended for businesses and professionals. You must provide accurate registration information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must use passwords that meet our stated requirements (including alphanumeric rules where applicable) and notify us promptly of unauthorized use.

3. Description of the Services

Feedico provides tools to aggregate, normalize, and deliver affiliate-network-related data (such as coupons, merchants, and metadata) through APIs, dashboards, and related features described in our documentation. Features, limits, uptime targets, and support levels depend on your plan and any order form or separate agreement. Data originates from third-party affiliate networks; availability and accuracy depend on those networks and your publisher approvals.

4. Orders, fees, and taxes

Paid plans, if offered, are billed as described at checkout or in an order form. Fees are exclusive of applicable taxes unless stated otherwise. Late or failed payments may result in suspension. Free or trial offerings may change or end with reasonable notice where permitted by law.

5. Acceptable use

You agree not to:

  • Violate applicable laws, third-party rights, or affiliate network program rules.
  • Probe, scan, or test the vulnerability of our systems without authorization, or bypass rate limits, authentication, or security controls.
  • Use the Services to distribute malware, send spam, or conduct fraudulent or deceptive activity.
  • Scrape, index, or bulk-export our non-public interfaces except as permitted by documentation and your plan.
  • Resell or sublicense the Services in a way that violates your agreement or misleads end users about the source of data.
  • Use automated means to create accounts or submit forms in a way that circumvents human verification (such as CAPTCHA) where required.

6. Your data and our processing

You retain rights to your business data. You grant us a license to host, process, and display your data as needed to provide the Services. You represent that you have lawful rights to submit any credentials and content you provide. Processing of personal data is described in our Privacy Policy; enterprise customers may execute a data processing addendum where required.

7. Intellectual property

The Services, including software, branding, and documentation, are owned by Feedico or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes during your subscription. You may not copy, modify, reverse engineer, or create derivative works except as permitted by law.

8. Third-party services and networks

The Services may interoperate with third-party affiliate networks and tools. Those third parties have their own terms and privacy practices; we are not responsible for their actions. You must comply with each network’s publisher agreements when using data obtained through Feedico.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA FROM THIRD-PARTY NETWORKS WILL BE COMPLETE, CURRENT, OR ACCURATE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Feedico, ITS AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

11. Indemnity

You will defend, indemnify, and hold harmless Feedico and its affiliates from claims, damages, and costs (including reasonable attorneys’ fees) arising from your use of the Services, your data, or your violation of these Terms or third-party rights, except to the extent caused by our willful misconduct.

12. Suspension and termination

We may suspend or terminate access to the Services for breach of these Terms, non-payment where applicable, legal or security risk, or extended inactivity as permitted by law. You may stop using the Services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction stated in your enterprise agreement, or otherwise by the laws applicable to the contracting entity identified on our website, excluding conflict-of-law rules. Courts in that jurisdiction have exclusive jurisdiction unless mandatory consumer protections in your country require otherwise. Before filing a claim, you agree to contact us to attempt informal resolution.

14. Changes to the Terms

We may modify these Terms by posting an updated version on this page and updating the “Last updated” date. If changes are material, we may provide additional notice. Continued use after the effective date constitutes acceptance, where permitted by law.

15. General

These Terms constitute the entire agreement between you and Feedico regarding the Services and supersede prior oral or written understandings on the same subject. If any provision is invalid, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.
